General Terms and Conditions – Jewelry Webshop

Article 1 – Definitions

In these terms and conditions, the following definitions apply:

Entrepreneur: the natural or legal person offering jewelry and related products via a webshop.

Consumer: the natural person who is not acting in the exercise of a profession or business and enters into an agreement with the entrepreneur.

Distance contract: an agreement concluded via the webshop or another means of distance communication.

Cooling-off period: the period within which the consumer can exercise their right of withdrawal.

Right of withdrawal: the consumer's option to withdraw from the agreement within the cooling-off period.

Article 3 – Applicability

  1. These general terms and conditions apply to every offer made by the entrepreneur and to every agreement concluded via the webshop.

  2. By placing an order, the consumer agrees to these general terms and conditions.

Article 4 – The offer

  1. The offered jewelry is described and depicted as accurately as possible.

  2. Small deviations in color, size, or finish may occur because many jewelry items are handmade.

  3. Obvious errors or mistakes in the offer do not bind the entrepreneur.

Article 5 – The agreement

  1. The agreement is concluded when the consumer places an order and it is confirmed by the entrepreneur.

  2. The entrepreneur reserves the right to refuse an order in cases of, for example, payment problems or incorrect data.

Article 6 – Right of withdrawal

  1. The consumer has the right to cancel the order up to 14 days after receipt without giving reasons.

  2. After cancellation, the consumer has another 14 days to return the product.

Article 7 – Consumer’s obligations during the cooling-off period

  1. The consumer will handle the product and its packaging with care.

  2. The product may only be unpacked to the extent necessary to assess it.

Article 8 – Exercising the right of withdrawal

  1. The consumer reports a return via email.

  2. The product must be returned in its original condition and packaging.

  3. Return costs are at the consumer's expense, unless otherwise stated.

Article 9 – Entrepreneur's obligations upon withdrawal

  1. The entrepreneur will refund the purchase amount including any shipping costs within 14 days of receiving the return.

  2. Refunds will be made using the same payment method as the original payment.

Article 10 – Exclusion of the right of withdrawal

The right of withdrawal is excluded for:

  • custom-made jewelry

  • personalized jewelry

  • earrings or jewelry that cannot be returned for hygienic reasons if the seal has been broken

Article 11 – The price

  1. All prices on the webshop include VAT, unless otherwise stated.

  2. The entrepreneur can adjust prices, but this does not affect orders already placed.

Article 12 – Performance and warranty

  1. The entrepreneur guarantees that the jewelry complies with the agreement.

  2. Normal wear and tear, improper use, or damage caused by water, perfume, or chemical agents are not covered by the warranty.

Article 13 – Delivery

  1. Orders are shipped to the address provided by the consumer.

  2. The entrepreneur aims to ship orders within 1–5 working days.

  3. Delays by the carrier are outside the responsibility of the entrepreneur.

Article 14 – Long-term transactions

If applicable, a consumer can always cancel an ongoing agreement with a notice period of a maximum of one month.

Article 15 – Payment

  1. Payment can be made via the payment methods offered on the webshop.

  2. The order will only be processed after payment has been received.

Article 16 – Complaints procedure

  1. Complaints can be reported via email.

  2. The entrepreneur will respond to a complaint within 14 days.

  3. The consumer and entrepreneur will try to resolve complaints in mutual consultation.

Article 17 – Retention of title

All delivered products remain the property of the entrepreneur until the consumer has paid in full.

Article 18 – Other provisions

  1. These terms and conditions are governed by Dutch law.

  2. Disputes will be submitted to the competent court in the Netherlands.
